Disparate Impact Rulemaking & Risks

date_range January 28th at 2:00pm EST
Registration ends at midnight the night before event (January 28th at 12:00am EST).

In 2020, the U.S. Department of Housing and Urban Development (HUD) finalized its revised standard to bring disparate impact claims under the Fair Housing Act (FHA). The final rule aligns with HUD’s 2013 disparate impact rule and with the U.S. Supreme Court’s 2015 decision in Texas Department of Housing and Community Affairs v. Inclusive Communities Project. The ruling added key limitations to ensure the burden of proof in disparate impact cases lies with the plaintiffs. Furthermore, the final rule speaks to how to rebut disparate impact claims. Join us as we discuss the revised standard and update you on its status.

What You Will Learn:

  • What is disparate impact?
  • What are the new elements that must be included in disparate impact claims?
  • How can defendants rebut disparate impact claims?
  • What is the status of the final rule?
  • What are the risks to financial institutions?

Who Should Attend: Compliance Officers, Auditors, Lending Staff, Operations Staff, and interested parties.
