In 2020, the U.S. Department of Housing and Urban Development (HUD) finalized its revised standard to bring disparate impact claims under the Fair Housing Act (FHA). The final rule aligns with HUD’s 2013 disparate impact rule and with the U.S. Supreme Court’s 2015 decision in Texas Department of Housing and Community Affairs v. Inclusive Communities Project. The ruling added key limitations to ensure the burden of proof in disparate impact cases lies with the plaintiffs. Furthermore, the final rule speaks to how to rebut disparate impact claims.
