Inaccurate furnishing of consumer information to credit bureaus can absolutely devastate a consumer’s financial health. That is why the FACT Act’s amendments to the Fair Credit Reporting Act were made years ago. With the onset of COVID-19, so many unprecedented developments in consumer lending, particularly in servicing, ensued, and left creditors bewildered as to proper reporting of credit activity to the credit bureaus. We take a brief look at the Accuracy and Integrity rules and Direct Dispute rules as they already are for context purposes, and then measure them against the guidance issued by the CFPB during the COVID-19 pandemic; regulatory expectations; industry trends especially in complaints; and steps financial institutions should take.
